The Smash Lab Participant Agreement, Assumption of Risk, and Waiver of Liability

Please read this document carefully before agreeing. It has legal consequences and will affect your legal rights. This agreement is made in favor of The Smash Lab, its managers, officers, employees, agents, volunteers, contractors, insurers, affiliated entities, and assigns (collectively “The Smash Lab”). You may refuse to accept this agreement and choose not to participate in Rage Room activities.

Assumption of Inherent Risks

In consideration of the venue (4 Meadow Street, Equestria, Pretoria East), equipment, and services provided by The Smash Lab, and my desire to participate in its activities now and in the future, I acknowledge, accept, and agree to the following:

• Inherent Risks: Activities at The Smash Lab are inherently risky, including but not limited to flying and floor debris, slipping and tripping hazards, confined spaces, collisions, surprises, impacts, sharp and jagged edges, shocks, stress, rebounds, acts or omissions by others, changing environmental conditions, equipment failure, physical exertion, unusual physical stresses, loud noises, and other risks not specifically named. For myself and my minor child (if applicable), I freely accept and fully assume all such risks.
• Strenuous Activities: The Smash Lab offers strenuous activities with known and unanticipated risks. Participation is voluntary and may result in injury. For myself and my minor child (if applicable), I freely accept and fully assume all such risks.
• Responsible Use: For myself and my minor child (if applicable), I agree to use The Smash Lab’s venue, equipment, and services reasonably, responsibly, and safely, participating within my physical ability.
• Rules and Directions: For myself and my minor child (if applicable), I agree to abide by all rules communicated by The Smash Lab’s employees and signage, and to follow all directions given by staff.
• Protective Gear: For myself and my minor child (if applicable), I agree to use available protective clothing and equipment, including a facial visor, at all times during activities.
• Health Considerations: Activities may cause significant physical, mental, and emotional stress. The Smash Lab recommends consulting a qualified physician prior to participation. Pregnant women should not participate. Individuals with medical conditions that may be triggered or worsened—such as asthma, epilepsy, cardiorespiratory issues, hypertension, mental illness, muscle/skeletal/joint issues, open or recent wounds, or other conditions not named—are advised not to participate. Those cautioned against such activities or intoxicated are prohibited from participating.
• Inspection: For myself and my minor child (if applicable), I confirm I have inspected the venue (4 Meadow Street, Equestria, Pretoria East), equipment, and services, and find them safe and acceptable for participation. I will immediately notify a staff member if I become aware of any unsafe condition.

Waiver of Liability

In consideration of the venue (4 Meadow Street, Equestria, Pretoria East), equipment, and services provided by The Smash Lab, and my desire to participate in its activities now and in the future, I, for myself and my minor child (if applicable), waive, release, and discharge The Smash Lab from any and all claims resulting from participation. This includes claims for personal injury (including death), illness, property damage, and loss or theft of property, whether caused by or related to the venue, equipment, or services provided by The Smash Lab.

Indemnification Agreement

In consideration of the venue (4 Meadow Street, Equestria, Pretoria East), equipment, and services provided by The Smash Lab, and my desire to participate in its activities now and in the future, I, for myself and my minor child (if applicable), agree to hold harmless, defend, and indemnify The Smash Lab from any and all claims arising from participation. This includes claims made by me, my minor child (if applicable), other participants, rescuers, or any other person.

Minor Child Participation (If Applicable)

If agreeing on behalf of a minor child, I acknowledge that I am allowing them to engage in potentially dangerous activities that may result in injury. I waive both my child’s and my rights to assert claims against The Smash Lab for any harm resulting from participation, including claims related to the venue (4 Meadow Street, Equestria, Pretoria East), equipment, or services. I may refuse this agreement and prevent my child’s participation.

Other Agreements

• Media Consent: For myself and my minor child (if applicable), I consent to video, photographic, and audio recordings during activities, and allow The Smash Lab to use them, including on social media platforms.
• Legal Venue: Any legal action related to participation or this agreement will be resolved in Pretoria, Gauteng.
• Age Requirement: I confirm I am 18 years or older.

Notice to Minor Child’s Guardian

If agreeing for a minor, read this carefully. By accepting, you allow your child to participate in potentially dangerous activities that may result in injury, and you waive your child’s and your rights to sue The Smash Lab for any harm related to the venue, equipment, or services.
